CONFIDENTIALITY AGREEMENT

1. PARTIES AND SUBJECT

This Confidentiality Agreement defines the boundaries of confidentiality and data security rules between the Client receiving services and the Psychologist providing the service through the platform operated by EVREKA ORGANİZASYON SANAYİ VE TİCARET LTD. ŞTİ. (hereinafter referred to as "EVREKA").

2. CONFIDENTIALITY OF SESSIONS AND EXCEPTIONS

2.1. Basic Principle: All information shared during sessions is kept confidential between the Psychologist and the Client. The EVREKA platform does not record these session contents and does not share them with third parties. 2.2. Legal Exceptions: In accordance with the Turkish Penal Code and relevant legislation; in cases where there is a risk of the Client harming themselves or someone else (suicide, murder, etc.) or suspicion of child/elder abuse, the Psychologist has the right and duty to break confidentiality due to legal notification obligations.

3. DATA PROCESSING AND KVKK (GDPR)

3.1. Processed Data: The Client's identity, contact, and payment information (excluding card details) are processed by EVREKA solely for the purposes of platform operation, appointment tracking, and billing. 3.2. Health Data: The Client's psychological state and session notes are within the scope of "Special Categories of Personal Data." This data is stored only by the relevant Psychologist within the framework of professional ethical rules for the purpose of performing the service; session content is not kept on EVREKA servers.

4. PROHIBITION OF RECORDING AND INTELLECTUAL PROPERTY

4.1. Audio and Video Recording: Recording of sessions by the Client or the Psychologist via audio or video is strictly prohibited in accordance with TCK No. 5237 and FSEK No. 5846. Unauthorized recording constitutes crimes of violation of personal data and violation of the privacy of private life. 4.2. Content Protection: Tests, documents, and materials on the platform belong to EVREKA; they cannot be copied or shared.

5. RESPONSIBILITY FOR A SECURE ENVIRONMENT

It is the Client's responsibility to ensure that the environment where online meetings take place is quiet, private, and secure in a way that third parties cannot hear. To prevent leaks arising from technical infrastructure, EVREKA works with KVKK-compliant service providers.

6. PROHIBITION OF COMMUNICATION OUTSIDE THE PLATFORM

The Client undertakes not to contact the Psychologist met through the platform via channels outside the platform (WhatsApp, social media, etc.) for ethical and commercial security reasons. All communication and appointment processes are carried out within the secure structure of the platform.

7. EFFECTIVENESS

This agreement is deemed to have entered into force simultaneously with the Client's membership to the platform and the approval of the "Distant Sales Agreement" and the "Clarification Text."
