MEMBERSHIP AGREEMENT

1. PARTIES

1.1. PLATFORM: EVREKA ORGANİZASYON SANAYİ VE TİCARET LTD. ŞTİ. (hereinafter referred to as "EVREKA"). 1.2. MEMBER (CLIENT): The real person who becomes a member of the www.evrekaparadise.com website or mobile application, shares their personal information, and receives services through the platform.

2. SUBJECT OF THE AGREEMENT

This agreement regulates the conditions for the Member to become a member of the platform operated by EVREKA, the rules for benefiting from the online psychological counseling services offered on the platform, and the mutual rights and obligations of the parties.

3. NATURE OF THE SERVICE AND LIMITATION OF LIABILITY

  • 3.1. Intermediary Role: EVREKA is an Intermediary Service Provider that brings together independently working Psychologists and Members in a digital environment. EVREKA cannot be held responsible for the content of the counseling service provided, medical results, or the personal opinions of the psychologist.

  • 3.2. Health Warning: The services provided on the platform do not constitute medical treatment, diagnosis, or emergency psychiatric intervention. In moments of crisis or in situations where there is a risk of harm to oneself/others, the Member must apply to the nearest health institution or emergency helplines (112, etc.).

4. MEMBERSHIP CONDITIONS AND OBLIGATIONS

  • 4.1. Accurate Information: The Member declares that all information provided during registration (name, surname, e-mail, phone, etc.) is accurate and up-to-date. The Member is responsible for any disruptions arising from providing false information.

  • 4.2. Account Security: The confidentiality and security of the membership password are the responsibility of the Member. In case of unauthorized use of the account, the Member must inform EVREKA without delay.

  • 4.3. Age Limit: To benefit from the platform services, one must be over the age of 18. For those under 18, membership and service acquisition can only be carried out through a legal representative (parent).

5. APPOINTMENT AND PAYMENT RULES

  • 5.1. Appointment Cancellation: The Member may cancel or postpone the appointment free of charge at least 6 hours before the appointment time. If this period is exceeded, the service is deemed to have been provided and no refund will be made.

  • 5.2. Technical Disruptions: In case of internet outages or systemic errors, if the session cannot be held, a new appointment is defined for the Member or a refund is made upon request.

6. ETHICAL AND SECURITY RULES

  • 6.1. Prohibition of Communication Outside the Platform: The Member agrees not to contact the Psychologist met through the platform externally by bypassing the EVREKA system and not to make payments outside the site.

  • 6.2. Prohibition of Recording: Audio or video recording of sessions is a crime in accordance with TCK No. 5237 and FSEK No. 5846 and is strictly prohibited. If detected, membership will be terminated immediately and legal action will be taken.

7. PROTECTION OF PERSONAL DATA (KVKK)

The Member consents to the processing of the data shared during registration within the framework of the Clarification Text. Member's credit card information is not stored by EVREKA; it is processed through secure payment systems.

8. EFFECTIVENESS AND TERMINATION

This agreement enters into force upon the Member filling out and approving the "Sign Up" form. The parties have the right to terminate the membership at any time. However, the financial and legal provisions in this agreement remain valid for ongoing appointments.
